The undersigned, who hereby give permission for the Student to participate in the Activity, acknowledge that the Activity is not part of the academic, sports or extracurricular programs at The Fenn School, Inc. (“Fenn”), and is not sponsored by, endorsed by, or connected in any way with Fenn. The undersigned further acknowledge that certain volunteers are responsible for supervision of (including, where needed, transportation to and from) the Activity, that no teachers or administrators of Fenn are overseeing or participating and that the Activity may be dangerous, including inherently dangerous, and involve risk of injury, death or disability to participants, including, without limitation, unavoidable risks. The undersigned authorize and give permission for volunteers to seek and obtain any and all medical treatment which they deem necessary or appropriate, including, if needed, anesthesia, for the student arising out of the activity and for medical personnel to furnish such treatment.

In consideration of the student’s being allowed to participate in the non-school activity, the undersigned agree on behalf of themselves and the Student that they release and forever discharge Fenn, its successor and affiliates and each of their trustees, officers, administrators, teachers and other employees and agents, and the volunteers and all of their estates, successors or assigns (the “Fenn Releasees”), from, and agree to hold harmless, indemnify and covenant not to sue the Fenn Releasees with respect to, all claims, demands, actions, damages and liabilities whatsoever, of every nature, including costs and attorneys’ fees, which the undersigned and/or the student now have or may in the future have or which the Fenn Releasees may incur relating to or arising from the students’ participation in the activity. They also agree that they and the Student fully assume all risks of injury, disability, death, loss or damage to person or property relating in any way to the Student’s participation in the Activity.

The undersigned also agree, on behalf of themselves and the Student, that they will defend, indemnify and hold harmless the Fenn Releasees from any and all claims, suits, demands, actions, damages and liabilities whatsoever, including without limitation expenses and attorneys’ fees, whether threatened or asserted in a legal proceeding, which may directly or indirectly result from or be related to any actual or alleged loss, damage or injury that is or allegedly is sustained by the student or other person, or to any property, as a result of the student’s participation in the Activity.

On behalf of themselves and the student, the undersigned (1) represent that they have the legal capacity and authority to act for, and on behalf of, the student and (2) acknowledge that they have read and understand this agreement and have signed it voluntarily. This Agreement shall be binding upon the heirs, executors, administrators and assigns of the undersigned and the Student.
